Terms and Conditions for Sale of Official Merchandise
Effective Date: 1st November, 2025 Event: FIDE World Cup Seller: MGD1 Esports LLP (“MGD1,” “We,” “Us,” “Our”) Venue: Rio Resort, Bardez, Near, Baga Beach Tambudki, Arpora, Goa 403518, India
1. General
1.1. These Terms and Conditions (“Terms”) govern the sale of official FIDE World Cup merchandise (“Merchandise”) by MGD1 Esports LLP to all visitors and spectators (“Customer,” “You,” “Your”) at the Event venue, whether delivered in person or shipped through any other means.
1.2. By purchasing Merchandise, You acknowledge and agree to be bound by these Terms.
1.3. MGD1 reserves the right to amend or update these Terms at any time without prior notice, and such changes shall take effect immediately upon publication.
2. Authenticity and Authorized Sales
2.1. All official Merchandise is sold exclusively by MGD1 Esports LLP or its authorized representatives.
2.2. MGD1 shall not be responsible for products purchased from unauthorized sellers, online platforms, or third parties.
2.3. The FIDE trademarks, logos, and event branding featured on the Merchandise are used under appropriate authorization and remain the property of their respective owners.
3. Prices and Payment
3.1. All prices are displayed in Indian Rupees (₹) and are inclusive of applicable Goods and Services Tax (GST), unless otherwise stated.
3.2. Payments may be made via cash, credit/debit cards, UPI, or other digital methods accepted at the sales counter.
3.3. MGD1 reserves the right to correct any errors in pricing or product information prior to completing a sale.
3.4. All sales are final upon issuance of a valid invoice or receipt.
4. Returns, Exchanges, and Refunds
4.1. Merchandise once sold is not returnable or refundable, except in cases of:
A manufacturing defect, or
Receipt of an incorrect item differing from the invoice.
4.2. Any request for exchange or refund must be made within 24 hours of purchase, supported by the original invoice and the product in unused condition with original tags and packaging intact. Where the Product is shipped to the address provided by the Customer, the Customer shall bear the charges for sending the defective product as well as shipping charges for the new product.
4.3. MGD1 reserves the right to inspect and verify any claimed defect before processing a replacement or refund.
4.4. Approved refunds will be processed via the original mode of payment within a reasonable timeframe.
4.5. No refund or exchange will be provided for size or preference-related issues once the product is accepted at the counter or shipped as per the instructions of the Customer.
4.6. The risk in the goods shall pass at the time of shipment and the Customer is responsible for any damages occuring in transit.
5. Product Care and Usage
5.1. Customers are advised to follow all care, washing, and handling instructions provided on product labels or packaging.
5.2. MGD1 shall not be liable for damage resulting from misuse, neglect, improper washing, or normal wear and tear.
5.3. The Merchandise is meant for Your end use and MGD1 shall not be bound for the end use by any other person.
5.4. All customary care and precaution should be taken while ensuring the use of the Merchandise and MGD1 does not make any representations or warranties regarding the Merchandise being sold.
6. Limitation of Liability
The total liability of MGD1, whether in contract, tort, or otherwise, arising out of or in connection with the sale or use of any Merchandise, shall be limited to the actual amount paid by the Customer for the said Merchandise. MGD1 shall not be liable for any indirect, incidental, or consequential losses, including but not limited to personal injury, loss of profit, or loss of enjoyment of the Event.
7. Data Protection and Privacy
7.1. MGD1 may collect limited personal information necessary for processing payments or issuing receipts.
7.2. All personal data shall be handled in accordance with applicable data protection laws and shall not be shared with third parties except as required for legal or transactional purposes.
8. Visitor Conduct
8.1. All visitors are expected to maintain orderly conduct while visiting Merchandise stalls.
8.2. MGD1 reserves the right to refuse service or cancel a transaction if a Customer engages in abusive, fraudulent, or disruptive behavior.
9. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising in connection with these Terms or any sale of Merchandise shall be subject to the exclusive jurisdiction of the courts at Pune, Maharashtra.
